Description of Practice:
Ms. Wintersheimer Findley is an employment litigation partner located in the San Diego office. She handles employment matters in both state and federal court as well as appellate matters. Ms. Wintersheimer Findley handles all manner of employment disputes including all forms of wage and hour class actions, wrongful termination, harassment and discrimination lawsuits. She has extensive experience in general employment counseling, in conducting employee investigations and in dealing with issues involving employee raiding and solicitation, as well as non-competition issues. She also frequently handles matters involving the Americans with Disabilities Act and Title 24 Access.
The following are notable examples of Ms. Wintersheimer Findley's recent litigation:
Seminis Vegetable Seeds, Inc. Obtained a defense verdict in a six-week jury trial alleging wrongful termination, age discrimination, breach of contract and violation of the Business and Professions Code in Moraghan v. Seminis Vegetable Seeds, Inc.
Volume Services America. In Payne v. Volume Services America, she successfully defended a four-week wrongful termination, retaliation, sexual harassment, discrimination, breach of contract and defamation action.
InFocus Corporation. Obtained a defense verdict in a three-week jury trial alleging racial harassment in Morris v. InFocus Corporation.
Sweet Factory. In Snyder v. Sweet Factory, obtained a defense verdict in a two-week jury trial alleging sexual harassment.
City of Escondido. Represented the city in Gravette v. City of Escondido and obtained a defense verdict in a month-long race and sex discrimination jury trial. Thereafter, the client was awarded attorneys� fees of over $170,000.
Manchester. In Medina v. Manchester, obtained a defense verdict in a two-week jury trial alleging sexual harassment and wrongful termination.
The Salk Institute. Obtained a defense verdict in a three-week jury trial alleging retaliation based on a sexual harassment and discrimination complaint in Sanders v. The Salk Institute.
Ms. Wintersheimer Findley is active in numerous community and professional organizations. She is an Adjunct Professor at San Diego State University and is a Member of the Enright Inns of Court. She is a member of the Board of Directors of the San Diego Blood Bank, the Big Brothers and Sisters of San Diego County, actively participates in the San Diego Volunteer Lawyers Program and the American Board of Trial Lawyers.
Educational History:
Ms. Wintersheimer Findley received her J.D. from the University of Michigan (1992) and her B.A. from Xavier University (cum laude, 1989). She is admitted to practice in all California state courts, United States District Court for the Central, Eastern, Northern and Southern Districts of California and all Texas state courts. Ms. Wintersheimer Findley is a member of the American Bar Association, Federal Bar Association and San Diego County Bar Association. Before joining Allen Matkins, she was a partner at Gray Cary Ware & Freidenrich from 1998 to 2004. |
