April Tabor works in the New York office as an associate in the Antitrust and Competition Practice Group. April's practice focuses on compliance with the Hart-Scott-Rodino (HSR) Act, defense of mergers and acquisitions before the Federal Trade Commission and the Department of Justice, consent decree negotiation, complex antitrust litigation, antitrust counseling in patent infringement and standard-setting matters, distribution practices and dealer termination, and consumer protection counseling.
Prior to joining McDermott, April served as an Attorney-Advisor to Commissioner Pamela Jones Harbour of the Federal Trade Commission, where she advised Commissioner Harbour on antitrust and consumer protection matters and worked on several Commission opinions.
During her tenure at the Commission, April also worked as a staff attorney in both the Mergers II and Compliance Divisions of the Bureau of Competition. While in the Mergers II Division, April's practice focused on merger litigation and investigation in the automotive, agrochemical, petrochemical, hardware, software, glassware, tobacco, and pharmaceutical industries. In 2003, April successfully challenged Chicago Bridge's acquisition of Pitt Des-Moines as part of an administrative litigation before the Commission. She also worked on the Commission's successful challenge of Libbey, Inc.'s acquisition of Anchor Hocking before the District Court of the District of Columbia in 2001 and negotiated the consent order entered by the Commission.
As an attorney in the Compliance Division, April was involved in consent decree negotiations for such complex merger investigations as AOL/TimeWarner and Dow/Union Carbide. She also worked on the FTC v. First DataBank/Hearst litigation, which resulted in a disgorgement award of $19 million, the highest penalty ever awarded for a Clayton Act � 7 violation. While at the Commission, April also served as a Special Assistant United States Attorney in the District of Columbia during a six-month detail prosecuting criminal matters.
April is a recipient of the Commission's Stephen Nye Award - the highest award given to a junior attorney - as well as an Award for Meritorious Service. She is a member of the New York State Bar Association, serving both on the Executive Committee of the Antitrust Section and as a Section Liaison for the Young Lawyers Section. She is also a member of the Antitrust Law Section of the American Bar Association and the Greater Washington Area Chapter of the National Bar Association. She is a revising author of the D.C. Practice Manual and a contributor to the FTC Practice Manual. April is admitted to practice in Maryland.
