Practice
Mr. Lenihan is a partner in the Firm�s International Corporate Department. He Co-chairs the Firm�s Finance Practice Group and is the Managing Partner of the Washington, D.C. office. Mr. Lenihan�s practice concentrates on corporate, project and trade finance, debt restructuring and derivatives. This includes representing corporate borrowers, institutional lenders, governmental entities and credit support providers in project financings, asset securitizations, note offerings under Rule 144A, export credit agency and federal loan guarantee programs, as well as senior secured and second lien financings. Mr. Lenihan counsels debtors and creditors on debt restructuring and recovery in the context of Chapter 11 bankruptcy proceedings, including Lehman Brothers, Calpine Corporation and US Airways.
Mr. Lenihan also advises on industrial and infrastructure project development and related trade, particularly in the energy sector. This includes experience in structuring joint ventures, commercial supply and off-take agreements, operating agreements, and tenders for engineering and construction contracts. He has particular experience in the oil and gas, petroleum and chemicals refining, power, transportation, steel and financial services sectors.
Mr. Lenihan led the Firm�s representation of the federal Air Transportation Stabilization Board (ATSB) in the implementation of its loan guarantee program which provided financial support to U.S. air carriers following the September 11, 2001 terrorist attacks. The ATSB representation included $1.75 billion in loans to six airlines secured by the carriers� unencumbered aircraft, spare parts, simulators and other assets. The representation also involved the successful recovery or restructuring for the government of three of the loans in subsequent Chapter 11 bankruptcy proceedings.
In 1993-1994, Mr. Lenihan was resident in the Firm�s Houston, Texas office. Before joining the Firm in 1982, Mr. Lenihan was a judicial clerk to the Hon. Lawrence A. Whipple, United States District Court for the District of New Jersey. He is admitted to the Bars of the States of New York and New Jersey, the Federal Courts in Southern District of New York and the District of New Jersey, and the Second Circuit Court of Appeals.
