Dave is a shareholder and chair of Graham & Dunn's Real Estate Team; he is also a member of the Financial Services Team and the litigation group. He has twenty-five years of experience in complex commercial litigation with an emphasis on banking, construction, real property and trade secrets/non-compete matters. Dave has represented plaintiffs and defendants, lenders and borrowers, landlords and tenants, developers and investors, buyers and sellers, franchisors and franchisees, contractors and owners and architects, alleged "disloyal" departing employees as well as jilted employers, in a very broad range of issues including complex creditor-debtor, e.g., fraudulent transfer and contested plan confirmation, issues in U.S. Bankruptcy Court. His litigation experience and expertise extends well past the real estate arena, with regular work in commercial contract and business disputes, e.g., representation of a Norwegian fishing company concerning a multi-million dollar sale in China; obtaining an emergency TRO for Merrill-Lynch freezing $17 million of securities at another brokerage; representing a major trust company in a trade secrets case brought by a national bank arising from the move of four key trust officers from the bank to the trust company; recent representation of a national bank in a case obtaining dismissal of all of the borrowers' $30,000,000 of "lender liability" claims. Dave brings to his litigation practice a unique quality for a litigator: the knowledge of an experienced transactional attorney, having negotiated and documented numerous major loan workouts, secured loan closings, real estate purchases and sales, commercial leases, non-compete agreements, and other business agreements.
