David J. Kessler is a partner in the firm�s Intellectual Property Practice Group. David�s practice is focused on intellectual property litigation and counseling, including patent, copyright, trademark, trade secret and licensing litigation. As part of his practice, David also advises clients regarding document management and electronic discovery concerns (including the establishment of non-litigation protocols and discovery compliance). David has also assisted clients in conducting internal investigations.
Electronic Discovery Counseling. As part of David�s litigation practice, he has counseled the firm�s clients regarding all areas of electronic discovery from vacating ex parte preservations orders, to handling collection of electronic data, to negotiating with opposing counsel regarding disaster recovery data. David has managed large electronic discovery projects involving high volumes of data and multiple vendors. In addition, David has advised clients regarding their discovery obligations and has developed document management policies and procedures to help account for these obligations in an efficient and thorough manner.
Intellectual Property Litigation. David litigates all aspects of intellectual property lawsuits with an emphasis on patent cases. David has represented both plaintiffs and defendants in numerous patent lawsuits all over the country involving disparate technologies such as implantable cardio defibrillators, dimming amplifiers, self-opening plastic bags, cotter pins, and CAD software. David has also represented plaintiffs and defendants in copyright litigation, primarily involving software or the Internet.
In General. David graduated from the Massachusetts Institute of Technology with undergraduate degrees in both economics and political science. David went directly to the University of Pennsylvania where he earned a master's in government administration from the Fels School and a J.D. from the Law School. He is admitted to practice before the United States Supreme Court, the Court of Appeals for the Federal Circuit, the State of New Jersey and the Commonwealth of Pennsylvania as well as various other federal courts.
Professional Memberships and Activities. David is a member of the Sedona Conference, the Litigation and Intellectual Property Sections of the American Bar Association and the American Intellectual Property Law Association (AIPLA). He is also a member of the Center for Professional Responsibility. |
