Description of Practice:
David L. Osias is a partner in the firm's San Diego office. Mr. Osias' practice has two distinct focuses: Bankruptcy & Creditors' Rights and Water Resources. On the bankruptcy side, he chairs the firm's Bankruptcy & Creditors' Rights Practice Group. Widely recognized as an authority on creditor and debtor rights in out-of-court workouts and restructurings, federal and state-court receiverships, and reorganization and liquidation bankruptcy proceedings, Mr. Osias represents a broad range of clients. Creditors typically are secured lenders and landlords, while debtors encompass a diverse spectrum of business enterprises. Mr. Osias also represents bankruptcy trustees and examiners, as well as official creditors committees. He has also served as an examiner in a multi-million dollar bankruptcy case. On the other side of his practice, Mr. Osias possesses expertise in a variety of water rights and water resources issues. He has appeared on behalf of clients before state and federal courts and the State Water Resources Control Board, and represents a broad range of industries including residential and resort developers and agricultural and industrial companies regarding surface appropriative and riparian rights, groundwater rights, entitlements under state and federal water contracts, reasonable use, waste and conservation, and the sale, lease and transfer of water and water rights.
Mr. Osias taught courses in water law at the University of San Diego School of Law for four years and was an attorney representative for the Southern District of California to the Ninth Circuit Judicial Conference for 1997-1999. He is a past director and president of the California Bankruptcy Forum and a founding member and past president of the San Diego Bankruptcy Forum.
Mr. Osias is a member of the American Bar Association Natural Resources Section, the Financial Lawyers Conference, the Commercial Law League, the American Bankruptcy Institute and the Section of Business Law of the American Bar Association. Mr. Osias also serves on the panel of bankruptcy mediators for the Southern District of California. A frequent lecturer at industry conferences, he has also spoken before a number of banking, real estate and legal groups.
