David Barton is a litigation associate in FLK's San Francisco office. His practice focuses on commercial litigation, securities law, and insurance law.
Mr. Barton joined FLK as an associate in 2002. Prior to law school, Mr. Barton was a visiting assistant professor of philosophy at the University of Oregon, University of California at Davis, and Swarthmore College.
Representative Matters
Obtained judgment in favor of defendant corporation in a wrongful termination lawsuit brought by high level executive who alleged violations of securities laws and over $65 million in damages. Case settled following appeal.
Successfully defended non-employee directors of major corporation in the health care industry in suits alleging securities fraud and ERISA violations.
Representing clients in internal investigations and SEC investigations.
Defending hospital in dispute with insurers regarding coverage for underlying False Claims Act litigation.
Education
Mr. Barton earned degrees from Stanford University (B.A., with distinction and honors, 1988), University of California at Berkeley (Ph.D., 1994) and University of California at Berkeley, Boalt Hall School of Law (J.D., 2002), where he was a member of the California Law Review.
