Mr. Hargett's practice focuses primarily on general, business, commercial, and complex litigation. He represents large corporations, small business, and individuals in federal and state courts, as well as arbitrations and mediations. Mr. Hargett represents plaintiffs and defendants and has experience handling litigation covering a broad range of matters, including disputes involving: contracts, construction projects, property damage, real estate, title insurance, securities, landlords and tenants, collections, estates, trusts, employment agreements and non-competition provisions, the sale/acquisition of businesses (including government contractors and 8(a) companies), intellectual property, corporate oppression/squeeze out and derivative actions, and transactions between financial institutions, borrowers, and third parties. In addition, Mr. Hargett regularly practices before the United States Bankruptcy Court for the Northern District of Alabama. As part of his bankruptcy practice, he has experience dealing with workouts, receiverships, fraudulent transfers, preference actions, foreclosures and repossessions, and a range of other matters. Representative Cases: Obtained a successful trial verdict in Morgan County, Alabama, in favor of title insurance company reforming a deed to real property. Achieved a favorable trial verdict in Lauderdale County, Alabama, in favor of a financial institution for a debt owed by a borrower/company under a loan agreement. Received a summary judgment in Madison County, Alabama, related to collection proceedings instituted against a local business. Represented financial institution in Chapter 11 bankruptcy case and helped client obtain the full payoff of a more than $700,000 debt owed to it by the debtors. (2007) Prior To Maynard Cooper: Mr. Hargett attended the University of North Alabama on a leadership and baseball scholarship. While at UNA, he received the Turris Fidelis Award for Outstanding Service to the University and the Gulf South Conference Commissioners' Trophy. He was named Disney's National Male Scholar-Athlete of the Year, Verizon's National Academic All-American of the Year, Alabama Sportswriters' Small College Athlete of the Year, a Rawlings' Baseball All-American, and an International Balfour Award Finalist. Mr. Hargett also served in several leadership positions, including President of the Sigma Chi Fraternity and Student Athlete Advisory Committee and Captain of the baseball team. Outside the Office: Mr. Hargett and his wife, Courtney, are both from the Northwest Alabama area. They currently reside in Huntsville, Alabama with their two children, Hugh and Barklee. |
