Doug Cuthbertson represents businesses, financial institutions and individuals in all types of commercial litigation. He has substantial litigation experience in Virginia state and federal courts. Mr. Cuthbertson regularly handles disputes involving breaches of contract, the sale of goods and services, commercial collections, business dissolutions, real estate, intellectual property rights, adversary proceedings in bankruptcies, and business torts, such as breach of fiduciary duty, fraud, conversion and defamation. Mr. Cuthbertson devotes a significant portion of his practice to the representation of banks, credit card companies, consumer finance companies and mortgage companies in suits arising under federal and state laws affecting the consumer financial services industry. Some of the results Mr. Cuthbertson has obtained for his clients include: The voluntary dismissal of a putative nationwide class action against one of the nation�s largest homebuilders and a leading mortgage-finance company alleging violations of the Fair Credit Reporting Act (FCRA), the Equal Credit Opportunity Act and the California Consumer Credit Reporting Agencies Act; The complete dismissal of a case against the nation�s leading student lender alleging violations of the FCRA; Individual settlement of a putative national class action against a leading accounts receivable management company involving telephone messages and the mini-Miranda warning under the Fair Debt Collection Practices Act; A defense verdict in favor of a global financial services and mortgage servicing company charged with violation of the FCRA and defamation.
