Edgar H. (Ned) Martin is of counsel in the firm's Litigation Practice Group. He has concentrated for more than 30 years in complex patent and trade secret litigation involving such diverse technologies as antibiotics, insecticides, algicides, medical devices, microprocessors, detection of explosive gases, power generation, machine tools, film coating, toys, and mechanical and electric devices for domestic and international clients.
Highlights of his litigation include:
Client awarded $55.8 million in damages for infringement of antibiotic patent.
Obtained decision holding defendants in contempt for violation of injunction and ordering destruction of all infringing antibiotic material as well as data generated by defendants' use of infringing antibiotic.
Obtained summary judgment of patent invalidity on ground of obviousness. Affirmance by Federal Circuit was that Court's first affirmance of a summary judgment of patent invalidity.
Obtained a judgment holding patent valid and infringed after another judge held the same patent invalid and not infringed on the same record. The ultimately successful patent owner and licensee had previously been represented by a different attorney.
Mr. Martin also successfully litigated patent and trade secret matters in the Federal District Courts, the Court of Appeals for the Federal Circuit, the International Trade Commission, and arbitration and mediation proceedings. He has consulted, analyzed, evaluated, and counseled clients with respect to ongoing litigation prior to trial at the request of the ultimately prevailing party and has analyzed and evaluated trade secret claims and defenses. He has consulted as a patent expert in litigation and arbitration of intellectual property issues.
Mr. Martin received his Law degree from Georgetown University Law Center in 1962. He received his bachelor's degree in metallurgical engineering from Rensselaer Polytechnic Institute in 1956. Before going into private practice, Mr. Martin was employed as an examiner in the United States Patent and Trademark Office.
Mr. Martin is admitted to practice in the District of Columbia, and before the United States Supreme Court, the Court of Appeals for the Federal Circuit, the United States District Court for the District of Columbia, and the District of Columbia Court of Appeals, as well as state courts throughout the country. He is also admitted to practice before the United States Patent and Trademark Office and the United States International Trade Commission. |
