Edwin H. Wheeler is a partner in the law firm of McDermott Will & Emery LLP based in the Silicon Valley office. Edwin is a member of the Intellectual Property, Media & Technology Department and emphasizes his practice in the areas of litigation of intellectual property, antitrust and other complex commercial disputes.
In over 20 years of practice, Edwin has worked on both the East and West coasts, and has litigated cases in courts across the country. Edwin has extensive experience in all aspects of intellectual property disputes, including patent litigation in federal courts and before the International Trade Commission (ITC); trademark and trade dress litigation; trade secret protection; and standards-setting issues. Edwin has handled patent matters involving a broad spectrum of technical fields, including hard disk drives, PCMCIA cards, network security software, modem communication, CD-ROM controllers, hardware emulation of electronic designs, maternal blood testing for fetal abnormalities, plant genetics and nuclear imaging.
Edwin has both counseling and litigation experience with a wide variety of antitrust matters in such areas as vertical restraints and distribution, price-fixing class actions and the intersection of intellectual property rights and the antitrust laws. He has successfully represented clients in arbitration and mediation hearings involving complex intellectual property, breach of contract and antitrust disputes. In addition to his litigation experience, Edwin has assisted clients in compliance with federal and state laws covering campaign finance, ethics, lobbying and the Foreign Corrupt Practices Act.
Edwin is registered to practice before the California and District of Columbia bars. He is a member of the American Intellectual Property Law Association, the Silicon Valley Intellectual Property Law Association, and the Antitrust Section of the American Bar Association.
