Francesco Mattina is a partner in the law firm of McDermott Will & Emery Studio Legale Associato, based in its Rome office. He is head of the Italian Intellectual Property, Media & Technology Department, where his practice focuses contentious and non-contentious IP advising on trademarks, patents, design, domain names, unfair competition and advertising. He advises both Italian and international companies in the defence and protection of intellectual property rights.
He represents many multinational clients in various industries, on a wide range of legal issues relating to intellectual property rights, before the Specialised Sections on Intellectual Property Rights. One of Francesco's most recent exploits was to assist a famous designer in the protection of his industrial design creations, obtaining a cross-border interim measure from the Specialised Section on IP rights of the Florence Tribunal.
Francesco is experienced with advertising issues in civil litigation regarding trade names and advertising matters. He has experience regarding both the Italian Advertising Self-Regulation system in proceedings before the Advertising Jury which examines the materials submitted and issues adjudications in accordance with the Code of Self-Regulation, and the Division of the Italian Antitrust Authority dealing with misleading and comparative advertising. Francesco represented a leading worldwide advertising agency before the Jury in a proceeding against an advertising campaign made for a major car manufacturer and a leading directory company against a major international telecommunications company.
Francesco received a Master of Intellectual Property and Information Society Law from the University of Alicante, Spain, and a Master of European Community Law and his J.D. from the University of Parma, Italy. He is admitted to the Bar of Rome.
Representative Experience:
Assisting Italian designer Raffaele Iannello in the protection of his industrial design creations, obtaining a cross-border injunction against Edizioni Design and Viceversa International Limited;
Assisting one Four Star Hotel Ritz in Italy in a trademark litigation, claiming the revocation in Italy of the Hotel Ritz Ltd.'s trademarks "Ritz" and "Hotel Ritz";
Assisting Illy Caff� in the execution of ex parte discovery proceedings for the protection of the design rights in the coffee's cup;
Advising two Italian designers in negotiating an utility model's assignment agreement with Novartis Consumer Health in connection to the Cibalgina due Fast dispenser;
Assisting the Swiss watch corporation Glycine Watch in a trademark and unfair competition litigation, obtaining the seizure of the infringing goods and of the defendant's accounting books;
Advising the Italian company Elcon Megarad in negotiating a patent and technology license agreement with a German partner for the production of a device to generate pressure for duct sealing;
Advising the Cuban venture company Corporaci�n Habanos S.A. on the use for advertising purposes of tobacco's trademarks in Italy.
