Mr. Kirby is experienced in all phases of mining engineering (reserve
evaluation, planning, development, cost analysis, ventilation, roof
control, surface mining, reclamation, and environmental permitting), coal
preparation (plant efficiency evaluation, planning and construction of
preparation plants, and evaluation of blending capabilities), and
production management of mining operations.
Mr. Kirby has over 28 years of experience in engineering and consulting
working on mining projects. His experience includes technical due
diligence for project finance and acquisition; geologic, mine plan and
economic modeling, construction monitoring, and operations audits. He
has been involved in detailed mine audits, fatal flaw analyses, and
operational reviews for mine operations, financial institutions, and
utilities. He has been utilized as an expert witness by both the mining
and utility industries in regard to mineral valuation and mining practices.
He has provided technical due diligence consulting for private debt
placements, leases, and public offerings in support of the financing of
power, coal, and industrial mineral projects. Mr. Kirby has performed
engineering studies and evaluations of coal and aggregate mine
operations and facilities throughout the United States.

Mining and Power Plant Due Diligence. Since 1999, Mr. Kirby has
managed and performed due diligence reviews to support the financing
or acquisition of mining and power projects. Projects reviewed cover a
wide variety of mining technologies, fuel qualities, and power facilities.
Fatal Flaw Analysis. Mr. Kirby has significant experience with power
generating utilities in the evaluation of long term supply agreements with
coal and limestone companies throughout the United States. These
studies have included the evaluation of existing and proposed mining
operations to assess their abilities to fulfill the proposed supply
commitments to the utility including quantity, quality, productivity, and
economics.
Operating Facility Reviews. Mr. Kirby has provided long-term
operations reviews for mining projects. His services include condition
assessment, performance trending and assessment, management and cost
review, maintenance planning, and environmental compliance.
