Gerald has more than 20 years' experience in business and tort litigation in state and federal courts in Texas and numerous other states. Through his broad-based commercial practice, he has developed particular expertise in litigation and arbitration involving intellectual property, media, securities, and fiduciary issues. His intellectual property experience includes copyright, trademark, trade secret, and patent counseling and litigation involving subjects ranging from battery technology, computer hardware and software, and telephone switching circuitry to business plans, music and film rights, literary works, and game designs. He has litigated right-of-privacy and publicity issues, unfair competition and trade dress claims, as well as licensing and infringement actions on behalf of both plaintiffs and defendants. Gerald has a wealth of experience representing broadcasters, publishers and entertainers in copyright and trademark matters as well as defamation, privacy, newsgathering, and other First Amendment issues. He represents corporate officers and directors, attorneys, trustees, partners and other fiduciaries in matters involving professional negligence, fiduciary duties, and federal and state securities claims. Gerald also has considerable experience representing parties in construction disputes, including architects and engineers. He has extensive experience representing foreign nationals. A frequent speaker and adjunct professor on litigation, intellectual property, and First Amendment topics, Gerald has been active in a variety of industry and bar organizations.
