Mr. Smith devotes his practice to commercial, intellectual property, internet law, consumer and health care fraud, and administrative law litigation. Mr. Smith's commercial litigation experience includes complex commercial and real estate transactions, environmental disputes, consumer protection and fraud matters, and franchise and construction law cases. Mr. Smith's internet experience includes litigation of cybersquatting, adwords, metatag, advertising and gripe sites. His intellectual property experience includes patent, trademark, and copyright cases as well as trade dress and trade secret litigation, and is supported by his undergraduate engineering degree. Mr. Smith has substantial experience with qui tam or whistleblower litigation under the federal False Claims Act and has filed numerous civil actions under the Act alleging fraud by medical providers against the Medicaid/Medicare programs. He currently holds the designation of Special Assistant Attorney General for prosecution of these cases on behalf of the State of Colorado. He also has extensive experience in state administrative law proceedings. Prior to joining the Firm, Mr. Smith was Deputy Attorney General and Chief of the Enforcement Section for the Colorado Attorney General's Office from 1982 through 1989. Mr. Smith served as a prosecutor with and later Director of the Colorado Medicaid Fraud Control Unit from 1979 through 1982. Mr. Smith was born in Rochester, New York. He enjoys skiing, golf, and high performance power boats. |
