Mr. Shire has had particular experience in major trademark and trade dress litigations. He played a major role in representing Toyota in the LEXUS case, one of the leading trademark dilution cases in the country, in which Toyota defeated claims of trademark dilution and trademark infringement asserted by Mead Data Central, owner of the LEXIS trademark for computerized legal research services.
He also helped to successfully defend BASF Corporation in a major trade dress litigation, which established in the Ninth Circuit the rule that a single color is not generally protectable under the U.S. Trademark Act.
Mr. Shire also played a significant role in Heidelberg Harris obtaining a jury verdict of infringement of two printing press patents by Mitsubishi Heavy Industries, which resulted in a multi-million dollar damages award for Harris.
In addition to his extensive litigation experience, Mr. Shire also counsels clients on various intellectual property matters, such as, for example, a variety of Internet issues, the selection of new trademarks and domain names, licensing of intellectual property, trademark coexistence agreements, and developing and implementing worldwide trademark registration programs. He has also coordinated major corporate acquisitions which involve the worldwide transfer of patents, trademarks and copyrights.
Clients have come from a wide range of fields, including the following industries: computer hardware and software, nutritional supplements, publishing, apparel, financial services, personal care products, and pharmaceuticals.
Mr. Shire is very active in professional and bar organizations. He is a former Editor-in-Chief of The Trademark Reporter, which is the leading scholarly journal devoted to trademark law. Mr. Shire currently serves as Editor-in-Chief of The Intellectual Property Strategist, a monthly publication, and Chairman of the Trademark Committee of the New York Intellectual Property Law Association (NYIPLA). He is named in The International Who's Who of Trademark Lawyers, and The International Who's Who of Business Lawyers. He has written research articles and has given speeches at programs organized by numerous bar groups, including the International Trademark Association, The American Bar Association, the American Intellectual Property Law Association, New York City Bar Association, NYIPLA, the Practising Law Institute, and the International Bar Association.
