Jim Flynn is a partner in the Bricker & Eckler LLP health care group with a practice emphasis general health care law, including hospital reimbursement, federal and state regulatory issues, fraud and abuse, False Claims Act, physician recruitment, corporate compliance, general corporate, allied health professions, medical staff and patient care issues. In these areas, he has appeared before federal and state courts, the Provider Reimbursement Review Board, state agency administrative hearings, and in medical staff hearings.
Representive Experience
Represented hospital in Riverside Methodist Hospitals v. Tommy Thompson (2003 U.S. Dist. LEXIS 15163, 2003), overturning disallowance of residents in IME count based on nature of residency program activities
Represented the Ohio Hospital Association in OHA v. Shalala (201 Fed. 3d 418, 1999), successfully challenging the government's use of the False Claims Act in Ohio's laboratory unbundling litigation
Represented hospital in Rush-Presbyterian-St. Luke's Medical Center v. Shalala (1997 U.S. Dist. LEXIS 13224, 1997), ordering the government to update reasonable compensation equivalent (RCE) limits
