James Kulbaski Biography :

James J. Kulbaski is a partner of Oblon Spivak McClelland Maier and Neustadt's Electrical/Mechanical Practice Group. His focus is on electrical technologies, with expertise in computer hardware, software, and digital video encoding. His practice includes all aspects of patent law including obtaining, managing, licensing, and enforcing patents and patent portfolios. He regularly practices with the firm's Litigation Department and is experienced both at the trial and appellate levels.

Mr. Kulbaski was retained in 2002 to assist nine Settling States in their on-going review of Microsoft's compliance with a consent decree which settled the Microsoft antitrust litigation. Mr. Kulbaski's primary role in this matter has been with the licensing of Microsoft's communication protocols, an essential part of the final judgment.

Mr. Kulbaski was a panelist at the 2002 Federal Trade Commission hearings on the topic of "Patent Pools and Cross-Licensing: When Do They Promote or Harm Competition?" and also presented comments at the FTC's hearings on Competition and Intellectual Property on the subject of patent pools and standards. He has also lectured to various bar associations and intellectual property organizations on the topic of patent pools and standards. Mr. Kulbaski has been a lecturer since 1999 for an international intellectual property program offered at the Federal Institute of Technology in Zurich, Switzerland. Mr. Kulbaski began his legal career as a patent examiner in the computer art at the U.S. Patent and Trademark Office in 1988 and 1989.

Mr. Kulbaski received his Law degree from the Columbus School of Law of the Catholic University of America and his Bachelor of Science degree in Electrical Engineering from Rensselaer Polytechnic Institute. Mr. Kulbaski is admitted to the Virginia Bar and is registered to practice as a patent attorney before the U.S. Patent and Trademark Office. His association memberships include the American Bar Association in which he chaired the Subcommittee on Trade Secret Protection of Computer Software in 1995-1996, the American Intellectual Property Law Association (AIPLA), and the Licensing Executives Society.
