Experience:
Jason Schmitz practices intellectual property law. He has experience in all areas of US and foreign trademark prosecution and is responsible for US and foreign trademark portfolios of numerous clients, including major US banking institutions and food industry corporations. He advises corporate clients regarding trademark availability, procurement and protection, and deceptive/comparative advertising issues and FDA labeling requirements. He develops worldwide trademark protection and enforcement programs, and he develops trademark use manuals for corporate clients.
Jason has experience in trademark and trade dress litigation in federal courts, as well as experience in trademark opposition/cancellation proceedings before the US Trademark Trial and Appeal Board. He has experience in various areas of intellectual property licensing, including patent and trademark assignments and licenses and other technology transfer agreements, joint venture and collaboration agreements, and product distribution agreements and secured lending and financing agreements for financial institutions involving patent, trademark, and technical collateral.
Jason also has experience in advising clients with respect to protection of trade secrets; experience in corporate mergers and acquisitions involving intellectual property assets; experience in IP securitizations; and experience in advising clients on copyright protection, registration, and enforcement; and experience in advising clients on the use of materials on web sites and related copyright and trademark issues. He also has anti-piracy experience that includes handling international counterfeiting issues.
