Jeffrey R. Gargano is a partner in the law firm of McDermott Will & Emery LLP based in the Chicago office. Jeffrey is a member of the Intellectual Property, Media & Technology Department and focuses his practice on litigation of disputes involving intellectual property in state and U.S. federal courts. He also counsels corporations on all aspects of intellectual property law, including obtaining, enforcing and licensing of domestic and foreign patents, trademarks, trade secrets, copyrights, false advertising and unfair competition.
Prior to joining McDermott, Jeffrey practiced in a full-service intellectual property law firm for fourteen years. Jeffrey has acted as trial counsel in numerous patent, trademark, copyright, trade secret, trade dress, unfair competition and false advertising matters.
Jeffrey's litigation, licensing and patent experience has involved diverse technologies including electro-luminescent materials for flat panel displays, water-soluble polymeric films, polymeric PTC materials, cross-linking of polymeric materials, over-current and over-voltage circuit protection devices, integrated circuits, printed circuit boards, medical devices and procedures, pharmaceutical compounds, methods for treating medical conditions, equipment and methods for manufacturing semiconductive wafers, food packaging equipment and methods, food sciences, metallurgical furnaces, metallurgical processes, architectural designs, automotive blade fuses, industrial tools, consumer hand and power tools, electro-magnetic transmitter/receiver systems, corrosion resistant packing films, disposable paper goods and their methods of manufacturing, paper printing and processing methods, e-commerce, business methods and financial products and systems, fitness equipment and physical training methods, sporting equipment, head impact telemetry systems, wireless communication systems, laminated financial, gift and ID cards and metal beverage cans.
As a registered patent attorney, Jeffrey also regularly prepares and prosecutes patent applications in the chemical, mechanical and electro-mechanical arts.
Jeffrey has developed particular expertise counseling Chinese companies looking to enter U.S. markets on all aspects of U.S. intellectual property and competition laws. On numerous occasions, Jeffrey has lectured in China to various Chinese companies, law firms and the Chinese Patent Office on all aspects of U.S. intellectual property law.
Jeffrey received his bachelor of science degree in chemical engineering. Prior to law school, Jeffrey was a test engineer with a semiconductor company.
Jeffrey has conducted numerous presentations including, "Patent Infringement Under the United States Patent Laws" at the State Intellectual Property Office, Beijing Peoples Republic of China; "Protection of Architectural Drawings and Designs Under U.S. Copyright Law" at the AIA national convention; and "Trademark Usage in Metatags Likely to Confuse" at the American Bar Association's Section of Litigation, Committee on Intellectual Property Litigation.
His professional affiliations include the American Bar Association - Intellectual Property Section, Litigation Section, the Chicago Bar Association and Intellectual Property Law Association of Chicago (IPLAC).
Jeffrey is admitted to practice in the state of Illinois and before the Supreme Court of the State of Illinois, U.S. Court of Appeals for the Federal Circuit and Eleventh Circuit, U.S. District Court for the Northern District of Illinois and numerous district courts. Jeffrey is admitted to the Trial Bar of the Northern District of Illinois and is registered with U.S. Patent and Trademark Office.
