Mr. Maynard's practice involves permitting, compliance and enforcement cases arising under state and federal environmental laws, including air and water, waste disposal and remediation, land use and wetlands. He has worked with clients and other attorneys on environmental matters that arise in transactional matters. His practice has a particular emphasis on negotiation of settlements with state and federal agencies for remediation of contaminated properties, including allocation of costs between parties and serving as common counsel to groups of parties in negotiating settlements. His practice also includes extensive experience in air quality permitting issues. He has extensive experience throughout the Midwest with state and federal environmental agencies, and frequently represents clients before Michigan and Illinois state agencies as well as the U.S. Environmental Protection Agency, Region V.
Mr. Maynard's focus is on working to help clients avoid environmental legal issues from arising, and in quickly resolving those issues in ways that do not adversely affect either the client's profitability or community image.
Prior to his law career, he was the Chief Medical Technologist for Calumet Public Hospital in Michigan and spent over thirteen years working in hospital clinical laboratories.
Experience
Serving as common counsel to PRP Groups at several Superfund Sites in the Midwest, including Janesville Disposal Sites, Tremont City Landfill Site, Byron Salvage Yard Site, MIG Landfill Site and HIMCO Landfill Site
Serving as expert witness in cost contribution dispute
Representing clients in Superfund and state remediation matters, including voluntary cleanup programs and including prosecuting and defending cost recovery and contribution claims
Defending challenges to air permits based upon challenges to PSD standards, ROP requirements and Title VI of the Civil Rights Act through the administrative processes, both state and federal, including appeals to the US EPA Environmental Appeals Board of PSD issues
Assisting clients in quickly and efficiently resolving enforcement issues for alleged violations of the clean air act, RCRA and EPCRA
Representing clients on nationwide environmental matters, including compliance with multiple state regulations
Assisting clients with due diligence reviews of potential acquisitions, advising them of potential environmental issues and working with clients to resolve those issues
Advising clients on Clean Air Act compliance, including new source review permits, triggers for prevention of significant deterioration (PSD) analysis, Title V Renewable Operating Permits and state air quality permits
