Jolene Cutshall's practice focuses on trusts and estates at Faegre & Benson. Her practice includes the following: Review, analyze, design and implement estate planning techniques for high net worth individuals, including tax-planning strategies and the preparation of wills, trust agreements and related documents necessary to implement the estate design Represent individual and corporate trustees in the administration of trusts and estates and in matters relating to fiduciary duties and powers, proper investments, and interpretation of trust agreements and wills Administer and distribute complex estates and trusts; prepare federal and state estate tax returns, federal and state individual and fiduciary income tax returns, and federal gift tax returns Represent interests in cases involving undue influence, breach of fiduciary duty, fee disputes, improper investment of trust assets and related fiduciary issues Represent beneficiaries and fiduciaries of estates and trusts with respect to protection of their beneficial interests and proper conduct of fiduciaries Represent clients in litigation and on appeal in estate and trust-related matters, including successful negotiations for settlement and a successful argument and appeal to the Nebraska Supreme Court in In the Matter of the Estate of Eickmeyer, 262 Neb. 17, 628 N.W.2d 246 (2001) Represent individuals in connection with charitable giving, including formation of family foundations Represent individual clients in connection with asset protection planning, including formation of trusts, implementation and administration of gifting programs, and titling of assets. |
