The only certainties in life are death and taxes.' I help my clients prepare for both. Using wills, trusts, LLCs, partnerships and other legal tools, I help people protect their assets, reduce and eliminate estate & capital gain taxes, avoid probate, and prevent family feuds that often arise when legal documents are not clear, concise, and thorough.
Randall "Randy" Holmgren's practice focuses exclusively on estate and asset-protection planning. He has received the highest possible peer reviews (AV rating) from the national rating service Martindale Hubbell. Randy was listed in Utah Business Magazine's listing of Utah's Legal Elite for 2007 and 2008. He helps people set up wills, trusts and other preventative planning systems all designed to make sure that client assets go to the right people, at the right time and in the right way. Mr. Holmgren helps survivors administer estates and trusts when people have passed away.
Estate and asset-protection planning encompass a range of protections for individuals and families when a person dies. These protections aim to reduce or eliminate federal and state death taxes -- and the delays, hassles and costs of probate. Randy also helps clients identify when and how they want children or grandchildren to receive inheritances. Many clients act on his suggestions in establishing college or other educational funds to help descendants improve their competitive qualifications in trades, businesses or professions. The ideal distribution of funds stems from the age-old debate of whether it is better to 'give someone a fish or teach him how to fish.' In that regard, clients benefit from Randy's suggestions for "incentive trusts", where individuals receive certain amounts of inheritance when they reach milestones educational, vocational or professional. Mr. Holmgren has taken thousands of clients through the entire process with forethought, planning and the use of air-tight legal documents to help them reach important estate and wealth goals.
Mr. Holmgren can also help identify what type of non-monetary legacy clients want to leave, such as values, beliefs, family name, and/or a commitment to certain charitable causes. Frequently, individuals don't take time to consider the value of their life to others and miss opportunities to leave a greater legacy than just money. Through estate-planning consultations, Mr. Holmgren helps clients identify what they want to accomplish and how to legally ensure it happens.
Mr. Holmgren's asset protection work includes identifying the precautions and preventative measures that can prevent the loss of assets at the hands of a bitter lawsuit or divorce. He also establishes the proper types of entities to ensure that protection. Time is of the essence when it comes to this type of planning as it must be done well in advance of possible calamities not at the eleventh hour.
Mr. Holmgren also helps owners of businesses, farms and ranches devise succession plans that will maintain assets in the event of the clients' unexpected death or disability. The client and estate lawyer must consider what impact death and inheritance taxes will have, how family members inside and outside the business will respond to continuing or liquidating the business and what influence children's spouses will have on the parents' intentions for these assets. This area of planning is most often neglected because it is often the hardest to clarify and put in writing. Randy has helped countless families roll up their sleeves and work on "the business" of ensuring the continuation and success of the business.
When estate planning has not been thorough, up-to-date, or not prepared at all, and courts must be used to administer the affairs of descendants. Randy and various Jones Waldo attorneys protect clients interests in probate and trust administration cases. With well-designed asset-protection plans, Mr. Holmgren helps clients shield assets from lawsuits, probate, taxes, and other perils.
