N. Rosie Rosenbaum is a partner in the law firm of McDermott Will & Emery LLP based in the Firm's Chicago office. As a member of the Firm's Trial Department, her practice focuses on insurance law and risk management issues, as well as on administrative agency proceedings, health care and general commercial litigation.
Rosie provides counseling and litigation services with respect to interpretation and construction of insurance policy language and coverage disputes, risk management issues, claims handling agreements for complex litigation and insurance regulation and insolvency. She provides insurance and risk management advice to a variety of health care systems, major corporations and other entities nationwide on coverage issues arising under liability insurance for general liability, excess, umbrella and hospital policies, as well as professional and directors' and officers' policies, and with respect to fidelity bonds.
Rosie also provides policy language for insureds with manuscripted commercial policies, for captive insurers and risk retention groups and for rating organizations. She conducts policy form reviews and comparisons for prospective insureds and assists clients in regulatory and other legal issues arising in the operation of a self-insured loss control and claims management program.
State insurance laws, rather than the federal bankruptcy code, govern the rights of policyholders, creditors and others when an insurer becomes insolvent. Rosie frequently represents and counsels clients with respect to insurance regulatory and guaranty fund proceedings flowing out of insurance company insolvencies. She advises clients in a wide range of issues, such as defense rights of policyholders involved in pending litigation, claim rights of insureds under various state guaranty funds, set-off rights of reinsurers and other creditors of the insurer and insolvency considerations in the provision of benefits to company employees.
Rosie is a member of the bars of the Supreme Court of the United States, the State of Illinois and the U.S. District Court for the Northern District of Illinois, including its trial bar. She is also a member of the American Bar Association, the Illinois State Bar Association and the Chicago Bar Association.
